Judge tosses Samsung's objection to patent video

Ahead Samsung's latest patent trial with Apple, Judge Lucy Koh overrules the company's request that an instructional video about patents not be shown to the jury because it includes shots of an iPhone an iPad.

If you're already keeping score in the latest patent battle between Apple and Samsung, mark down a strike against Samsung.

Judge Lucy Koh of the US District Court of Northern California on Sunday overruled Samsung's objection to an instructional video on the patent system that will be shown to the jury in the latest Apple-Samsung patent infringement case, which kicks off on Monday.

Samsung objected to the video, which was created by the Federal Judicial Center to give jurors a basic understanding of patents and how they work, because it includes several scenes that show Apple products. According to Recode, which earlier reported the news, Samsung filed a motion on Friday that said showing the video to a jury would be "highly prejudicial to Samsung" since Apple's "alleged innovation" is a central dispute in the trial.

Instead, Samsung apparently wanted jurors to be shown the (much) older introduction to patents video that the jury was shown before the last patent infringement case between the two tech giants.

Apple and Samsung head to the courtroom again on Monday for the latest trial in a long-running patent infringement spat that has involved jury trials, International Trade Commission disputes, and numerous international suits. This latest trial involves different patents and newer devices -- including Apple's iPhone 5 and Samsung's Galaxy S3 -- than the ones disputed at trial in August 2012 and in a damages retrial in November 2013.
